A School Choice Victory in Kentucky

A school choice victory in Kentucky this week as Republican lawmakers overrode Democratic Governor Andy Beshear's veto of a bill that would allow the state to take part in a new federal tax credit scholarship program. Bowing to pressure from the teachers' union, and with his eye on a possible 2028 White House run, Beshear allowed the bill to sit on his desk for nearly two weeks before issuing the veto, saying it would divert public money to private schools. More than two dozen states have now opted in to the Trump-backed program, which offers credits up to $1,700 on federal taxes for donations to scholarship organizations. We are back with our panel. Bill, the legislature overrode Beshear. So he knew that was going to happen. So why veto a bill when he knows it's irrelevant?

I think they still have to pay tribute to the union chiefs and everything. Look, the whole reason it's an issue is unions block choice when everyone clearly wants it. So what's different is they were able to do this in the past and only like people that follow it and you and I know the subsidy's gone to the union and so forth, and the ordinary people didn't know it. Now, people are seeing for themselves. They see states that have choice and what the parents there have, and they see themselves. Does anyone, like just take an example, looking at Chicago, believe that that system is working? No one believes it. So I think as the red states and a spattering of blue increasingly experiment with choice, it's gonna be harder and harder to play that game, you know, and deny parents opportunities that they get elsewhere.

Allysia, what about Beshear's point that opting into this program would take money from public schools to give to private schools? Is that accurate?

No, it doesn't cut money for public schools at all. It would just provide parents with more choice. Now, what these teachers' unions and public schools are worried about is that more students will opt for private schools or, you know, micro schools, which have been growing in many states after the pandemic. As a result, some public schools will actually lose students and many school state funding formulas therefore result in less per-pupil spending on these schools. And you may have, if more and more public schools lose more and more students, they may actually have to lay off some teachers, and that results in less union dues for the teachers' unions.

And Kim, there's no money that this would cost Kentucky public schools at all since this is a federal tax credit program, and states have to opt into it before the scholarship tax credit can be paid in their organizations, in their state. 28 other states have opted in, including Colorado, which has a Democratic governor. But a lot of other democratic governors who wanna be president are gonna maybe have to face a tough choice about whether to buck the unions on this, including JB Pritzker in Illinois and Josh Shapiro in Pennsylvania.

Yeah, Andy Beshear should have a call with his buddy Jared Polis, who is the Democratic governor of Colorado, who said, "Of course, I'm opting into this. Why would I not sign up for something where a bunch of people, probably who live outside of my state, are gonna direct money to Colorado that kids can use for school choice?" This is the right approach politically, but it also, Paul, underlines the massive problem Democratic governors and politicians have, and the unions have, as school choice grows. This is something that's incredibly popular with parents, and this federal tax scholarship program is really putting that in relief. 28 states, as you say, have so far said yes. And we have a number of Democratic states that, out of pure anti-Trump peak, initially came out and said, "We're never doing this." And now that they've heard from parents, they are rethinking that. So governors in Hawaii, New Mexico and Oregon all recently came out and said, "Well, we'll take another look at this." It's putting folks like Pritzker in a bind, Josh Shapiro. They are sort of holding out, waiting, saying they wanna see more about the rules, but this is something that, if they say no in the end, it could well hurt them in the ballot box. And this is a decision facing Democrats everywhere now.

And the evidence of that, Bill, is that, in the ballot in the Illinois primary this week, in some counties that had it, it was non-binding, but when it was on the ballot saying, "Should we opt in or not?", every one of them voted to opt in. And some Chicago teachers' unions-endorsed candidates actually lost this time. How significant is that?

I think it's hugely significant. As I say, the show is busting up. They can no longer do all these backroom things to benefit the unions. People see it. They see the neighboring state have choice, saying, "Why can't my kid do that?" Opt to go to the charter school or parochial schools is better. So much of the education policy of the Democrat party has been to keep people trapped in these miserable schools. It was bound to lose over the long run. And I think it's just started right now.

But the teachers' unions still dominate the politics in some of these states, Bill. They just can't get it through.

Well, I think like New Jersey, New York, Illinois, California, they'll be the last to do it. But a lot of states that are swing states or mildly blue, I think they'll have them or limited choice.
