Trump's Rules for Schools

The White House, last week, sent letters to nine of the nation's top public and private universities offering these institutions preferential access to research funds if they agree to what the administration is calling a compact for academic excellence in higher education. The 10-page agreement would require colleges to freeze tuition for five years, cap the enrollment of international students, and commit to reforms to their admissions process and campus speech codes, among other things. Schools that sign on would receive what the administration calls multiple positive benefits, including substantial and meaningful federal grants. We are back with our panel. So, Allysia, let's break down some of the items in this compact. What do you like in it?

Well, I think there are a lot of good ideas, but not necessarily things that the government should be doing, or enforcing, on colleges. By good ideas, I mean the tuition freeze, Purdue has done that, they've also suggested basically clamping down on grade inflation. But again, how do you do that? Is that really the government's role? Something that I think that is a good idea that the government can do is basically enforcing prohibitions against discrimination based on race, and gender, or sex.

That's law, they have to follow that.

Exactly, that is the law. But a lot of the things that are in this are just basically overreach. There's a case for maybe states doing this for their public universities, but the federal government, if it really wants to promote merit, it's undermining that, basically, by saying, "To get these research dollars, you have to follow our government objectives."

Paul: Jason.

Well, I agree with everything Allysia said, including the problem on enforcing some of these provisions, like, for instance, institutional neutrality. Does that mean it doesn't want schools out there saying, "Divest from Israel", okay? But does it also mean that a college professor can't go on Fox News and talk about a recent Supreme Court decision?

No, in fact, that's not what it means. And the individual faculty members can say whatever they want. What it means is, though, the department of history, say, cannot say, "We have official position on the Arab-Israeli conflict, or on the American Civil War."

So that's something the University of Chicago has been doing.

Exactly, Dartmouth has signed on to it as well. Others have.

The other problem I have here, though, Paul, and this is more fundamental, is what happens when a Democratic administration takes over and puts together its compact. "Forget freezing tuition, free tuition for everyone on campus if you want federal funds. Unionization of all campus labor forces if we want federal funds." So that's the problem. I don't think that this is very forward-thinking, because the Trump administration, conservatives or Republicans, will not always be in charge of implementing these compacts. And so I think there's a little shortsightedness in that regard.

And MIT, which is one of the schools, and the schools, these nine, were cited as good actors who might be willing to accept these terms. But MIT came out and said, on Friday, "Thank you very much, but no. We think this would compromise our freedom of expression and our independence." Is that what we're gonna see with most of these schools?

Yeah, I think many of them will. And, I mean, I agree with all that's been said. I think this is directionally right from the Trump administration in terms of where higher ed should go, but it looks to me like a lot of overreach and micromanaging from Washington. I mean, to cite another thing, they're talking about having schools put their admissions criteria on their websites, requiring every undergraduate to take a standardized test like the ACT and the SAT. That is a great idea. Schools should definitely do that. The move away from standardized testing, I think has been an effort to muddy the waters, holistic admissions processes and whatnot. And on the tuition freeze, I mean, that's getting really into the business of being a university. And, I mean, it basically comes down to a price control from Washington. By the way, under penalty, the compact says, "Enforced by the Justice Department." If they're found to be in breach, they'd have to give back federal money, and they would also have to give back any private donations to any donor who asks, which is a really big weapon for any school like that to sign over to whoever's running the Justice Department.

Okay, you guys. But let's take it from the Trump administration's point of view. What they would argue, I think, is, "Look, these schools don't wanna do what we're suggesting. And without any prod from the federal government, in fact, without the use of the threat of withdrawing funds, they will not do it, Allysia, and therefore we have to do this." Because these institutions, in many respects, have become hostile to the American enterprise, to American liberty, preaching antisemitism and violating the civil rights laws. What's your response to that?

Well, one, I think that there is actually a marked response. There are a lot of students and parents who are now looking to go to other universities like the University of Florida, the University of Texas, which are actually promoting more civics education, and are opposing those kind of leftist woke ideology in the classroom. Now, I also think that the Trump administration could use different levers. Perhaps they could actually freeze the student loan, there's a cap on student loans that escalates with inflation, maybe freeze that, and that would actually cause colleges, in turn, to freeze their tuition. But there are a lot of things that you could do within the law that aren't overreach to reform these institutions.

Jason, briefly respond to my provocation.

They're right in many respects. And we learned that with the Students for Fair Admissions v. Harvard case, that schools have been lying. They've been lying about what they've been doing, and they've been called out now by the Supreme Court. And I think, when it comes to enforcing things like civil rights laws, whether protecting students, or making sure that students are being admitted on race-neutral grounds, that is a role for the federal government to enforce. But again, it's about overshooting. That's the concern here.
