Trump Administration Lawyers Defend Deportation Flights to El Salvador

Shelby: The three planes that appear in this video posted by El Salvador's President are the focus of a high stakes legal showdown centered around a key question. Did the Trump administration defy a judge's orders demanding that those planes turn around and come back to the United States? Those planes were shown unloading deportees early Sunday morning, before the deportees were taken to El Salvador's mega prison. So here's what we know about those planes and why the timing of the flights matters. On Saturday night, at approximately 6:45 Eastern, US District judge, James Boasberg, issued a verbal order blocking President Trump from using the 227-year-old Alien Enemies Act to deport non-citizens, which Trump had invoked earlier. He said in court, "Any plane containing these folks that is going to take off or is in the air, needs to be returned to the United States." At 7:26, "The judge's written order hit the docket, blocking the administration from deporting non-citizens under the law." It didn't explicitly demand that planes be turned around. By that time, two El Salvador bound flights had taken off from a deportation hub in Texas, one at about 5:25 PM Eastern and the other at about 5:44. A third was still on the ground in Texas and did not take off until 7:36, 10 minutes after the written order was posted. Flight tracking data shows that when the judge ordered the planes to turn around, a blue global X plane had just crossed into Mexican airspace over the Yucatan Peninsula, a white Global Crossing Airlines, also operated by Global X, was flying over the Gulf and a white GlobalX plane was preparing for takeoff in Texas. Despite the order, flight tracking information shows all three planes continued onto Honduras, and from there, they flew to El Salvador, arriving at 12:10, 12:18, and 1:07 AM respectively. Deportees can be seen exiting all three of those planes, including the white GlobalX plane which departed Texas after the judge's orders. In a court filing, the administration said the people on that plane weren't removed under the Alien Enemies Act and that they had Title VIII final removal orders. After the flights had landed, President Nayib Bukele, retweeted a news story about the judge's order writing "Oopsie too late." And President Trump thanked Bukele on social media. At a press briefing Later, White House Press Secretary Caroline Levitt seemed to suggest that the administration was only following the written order.

There's actually questions about whether a verbal order carries the same weight as a legal order, as a written order, and our lawyers are determined to ask and answer those questions in court.

Global X, which has a contract with immigration and customs enforcement, didn't respond to a voicemail seeking comment. Several legal experts noted that written and verbal orders carry the same weight and that the deportees were still in US custody at the time of the judge's order, and shouldn't have been turned over to El Salvador.

Judges give verbal orders all the time and they're absolutely binding on litigants.

Shelby: But many Republicans praise the administration for its move and have joined Trump in calling for the judge to be impeached. On Tuesday, Chief Justice John Roberts issued a rare public statement saying, "For more than two centuries, it has been established that impeachment is not an appropriate response to disagreement concerning a judicial decision. The normal appellate review process exists for that purpose.
