From ‘Mother’ and ‘Father’ to ‘Gestating Parents’ 

As New York's first mom and also first grandma governor, I am proud of the work we're doing to deliver for families.

The question is, will New York's first mom governor sign new legislation to purge gendered language from state family law?

This bill before us right now for a vote replaces the terms father and mother to gender neutral language in New York State's laws. I vote no.

Under the bill that passed in Albany, the word mother would be replaced by gestating parent, and father, non-gestating parent.

Ayes 46, nayes 15.

Bill is passed.

The bill says that proceedings to establish a parentage, and that's the new word for paternity, can be started by the gestating parent or the alleged non-gestating parent.

The bill is really to adjust to modern times and different families that you have today, ad the way you define those parents of those children.

Mr. Sepulveda, a Bronx Democrat who sponsored the legislation, pointed to a 2016 case involving two mothers.

One of the mothers, it's two mothers, had the child, the other, they got divorced, and one of the parents tried to assert their rights of visitation, and the lower court said, no, you're not a parent according to the biological definition. But then it was overturned, and they said that it's really intent, actual parenting intent and conduct that determines who is a parent.

Opponents of the bill don't buy it.

We've gone down the rabbit hole and we've gone way too far to the point where it just seems like we're afraid to use terms that are so obvious.

Mr. Murray said that he accepts there are cases in law that need to be adjusted or fixed, but that this goes too far.

A mother is a mother, a father is a father. If you need to determine, change that in some case or some specific part of law, okay, we can address that, but I feel like we've gone so far off the path here to the point of eliminating mother, of eliminating father.

He also pointed to another glaring contradiction.

It was just earlier that we passed a resolution, I believe it was last week, for Maternal Mental Health Awareness Month. Maternal. That definition is an adjective that relates to a mother or motherhood. I hope you're getting my point here. My point is these terms do matter. They matter in society, they matter in real life, and they matter to us as individuals.

Mr. Murray might have added that changes to language like this, done to placate an ideological special interest, are one of the reasons why millions of voters think Democrats have lost their minds.

Gestating females, you know, mothers, and fathers are non-gestating, you know?

I saw that. I mean, what are we doing here?

Oh my God.

I mean, this is a-

So we're not supposed say mother and father now? We can't say mother and... You know what, that's disgusting. Okay, that is disgusting.

Yes.

What a mother goes through, a woman goes through to have a child, and to raise that child, and parent, that now we have to take that away from them, calling them mother and father?

If updates to the law are needed, why can't Albany do them in language that New Yorkers recognize?

I'm not familiar with what was introduced late last night, so I'll take a look at it, but I have until the end of the year to review them and make a decision, so I won't be commenting on pending legislation.

Since then, Ms. Hochul's office tells us the governor believes mothers are mothers and fathers are fathers, and no legislation changes that, going on to say, "The legislation, which we will review, appears to address technical legal issues related to surrogacy and parentage. Anyone making bad faith arguments is deliberately misleading New Yorkers for political gain."

As I said before, one of the most sacred titles you can have, and any mother in this chamber will tell you, is the term mother. And any father here will tell you the same thing. And we are eliminating those, and I think we've gone too far.

Kathy Hochul has plenty of time to decide what to do with this bill, and it's possible that we won't get an answer until after the November election. Too bad, since a veto on June 21st would've been a nice gift to the millions of voters celebrating non-gestating parents' day.
