The ‘International Law’ Illusion in Venezuela

I remain deeply concerned that rules of international law have not been respected with regard to the 3 January military action.

Elliot: That was part of a statement made on behalf of UN Secretary General Antonio Guterres in an emergency meeting on January 5th, the day Nicolas Maduro and his wife made their first appearance in court in New York.

It's clearly illegal under international law, right? No, full stop. UN Charter, no question there.

Judging by the reaction from some Democrats and foreign leaders, international law is fast becoming a tyrants best friend. Russia called this an act of armed aggression. Hamas condemned the Maduro arrest as a grave violation of international law and an assault on the sovereignty of an independent state. It would be nice to think we live in a Wolfsonian garden where law governs relations among nations.

Elliot: We don't.

Today, rogue regimes are on the march and international law, especially when interpreted by the reigning complex of professors, NGOs and multilateral bureaucrats, all too often ends up protecting the law breakers. The frequent citation concerning Venezuela is Article II, Section IV of the UN Charter.

The charter enshrines the prohibition of the threat or use of force against the territorial integrity or political independence of any state,

But dig a little deeper and the analysis becomes muddy. First, is the US intervention a violation of Venezuelan sovereignty when the country's legitimate authority consents to it?

Today, the person who usurped power is no longer in the country and is facing justice.

The day after the operation, Edmundo Gonzalez, who was elected by the Venezuelan people in 2024, spoke in support of the operation. The Maduro regime, which stole the election, objects.

Elliot: The bipartisan US position is that Maduro wasn't the legitimate president. In addressing the UN Security Council meeting on January 5th, Mike Waltz pointed out that more than 50 countries had rejected the legitimacy of Maduro's reelection.

If the UN and the united nations in this body confers legitimacy on an illegitimate narcoterrorist and the same treatment in this charter of a democratically elected president or head of state, what kind of organization is this?

Second point, does the intervention qualify as US self-defense against the Venezuelan regime's drug smuggling and use of migration as a weapon?

It is important to point out. The United States has never accepted any interpretation that the UN Charter limits the use of force solely to responses to armed attacks.

In 1989, the US also claimed self-defense as grounds to arrest Panamanian dictator Manuel Noriega. A Justice Department opinion by Bill Barr, later, the Attorney General, found that, quote.

Narrator: Article II, Section IV relates to one of the most fundamentally political questions that faces a nation. When to use force in its international relations.

That isn't for a court, unaccountable to the people, to decide.

So what China and Russia just learned is that the beacon of liberty and rule of law in the world has now green-lighted snatch and grab operations in Estonia, in Taiwan, wherever Xi and Putin decide they want to go next.

The reaction from politicians who should know better was instantaneous. No, President Xi isn't waiting on a new legal interpretation to seize Taiwan. That's what his military buildup is for. China has ignored the international ruling against its island grabs in the South China Sea and repeated vetoes by America's adversaries have neutered the UN Security Council.

We're not going to allow the Western hemisphere to be used as a base of operation for our nation's adversaries and competitors and rivals of the United States. You can't turn Venezuela into the operating hub for Iran, for Hezbollah, for gangs, for Cuban intelligence agents, and other malign actors that control that country.

Liberal internationalism is a moral and political failure if it can't distinguish between the aggression of Russia and China to swallow neighboring democracies, and a US military action to arrest a lawless dictator in league with the world's worst actors.
