Nuking the Filibuster to SAVE America

I will be bringing the SAVE America Act to the floor, and we'll be having a full and robust debate.

Aside from presidential appointments and the budget reconciliation bill, the filibuster remains for just about everything else. That's the three-fifths 60 vote threshold to end debate and vote on a bill.

We gotta figure out how to get it passed.

In the Senate, the minority party can block the majority or force concessions from it on just about anything, but a question bugging Republican voters today, should it remain so? For more than three decades and the presidencies of Bill Clinton, Barack Obama, and Joe Biden, anytime Democrats held the White House and both Houses of Congress, liberal commentators and democratic lawmakers would demand an end to the filibuster.

I'm not busting my chops to become majority leader to do very little or nothing.

I am prepared to get rid of the filibuster to pass a Green New Deal.

By 2021, this view had become an obsession. An ascendant progressive left wanted it and their senators were prepared to give it to them.

The far left is salivating over the prospect of killing the filibuster in order to pack the Supreme Court and pack the Senate with new states, tilt the playing field permanently so they can never lose power again.

The following year, 48 of the 50 Democratic senators voted to kill the filibuster.

On this vote, the yays are 52, the nays are 48.

As for Republicans, they held the White House and Congress for much of George W. Bush's presidency and for the first two years of Donald Trump's. But they never expressed an interest in eliminating the filibuster altogether and turning the Senate into just another house, ultimately creating a European style parliament in which the party in power does what it wants and the minority can only speechify against it.

Every time those rules have been modified up to and including the most recent changes on the legislative calendar, they've been modified in accordance with the rules, not using the nuclear option, breaking the rules so we can change the rules.

Republicans only started flirting with the nuclear option as it's come to be called last fall.

The motion is not agreed to.

Barton Swaim: When Mr. Trump urged to the Senate GOP Conference to abolish the filibuster and so end the government shutdown.

I would nuke the filibuster to pass the SAVE America Act.

But lately, the President has made the same demand more forcefully to pass a sprawling voter ID bill called the SAVE Act.

The real reason this president wants this bill to pass is to reduce the number of people voting in the November election.

While mostly in accord with Republican interests, the SAVE Act accepts the fiction that illegal aliens vote in large numbers, and so would require proof of citizenship to cast a ballot. It also all but abolishes mail-in voting, a practice now happily embraced in many Republican states. The bill won't pass. But for this, some number of Republican senators now say they're ready to hand over all power to block legislation when they find themselves, as surely they will, in the minority. Some of these senators know the SAVE Act can't pass, but they insist, not without reason, that the Democrats will scuttle the filibuster as soon as they're in power.

It's really about the only way I could see preventing them from nuking the filibuster once they gain the majority in the Senate.

The two Democratic dissenters in the 22 vote, they point out, Joe Manchin and Kyrsten Sinema, have since retired, in part as a consequence of their dissent on the filibuster. But would Democrats actually do it or almost do it? The 48 who went nuclear knew the attempt would fail. There was more value for them in signaling to the zealots in their party that they wanted to get rid of the filibuster than in actually getting rid of it.

Nothing's on the table. Nothing's off the table.

That vote, bear in mind, took place at the tail end of pandemic era woke madness.

Have to wait till we get the majority before we can decide what to do.

Republicans won't ditch the 60 vote rule, but Mr. Trump's fulminations have given them the Democrats problem.

SAVE America Act.

The GOP base now wants it, so Republican senators may have to do what the Democrats did, almost nuke it until they're in the minority again and the base loves the filibuster.

Do you run a risk of being on the wrong side of President Trump in your resistance to do this talking filibuster tying the Senate in knots for weeks?

We don't have the votes either to proceed, get on a talking filibuster nor to sustain one if we got on it.

Interviewer: Does he understand that though?

Well, we've conveyed that to him. I'm the one who has to be the clear-eyed realist about what we can achieve here.

There's a reason browsing about the filibuster has until recently come from the left, not the right. By nature, progressives want to remake the world according to their own utopian vision, and that's far easier to do with 50 plus one votes than with a three-fifths majority. As for Mr. Trump, he won't get his way on the filibuster and Republicans won't have to regret that he did.
