Climate Regulation Liberation Day

If finalized, today's announcement would amount to the largest deregulatory action in the history of the United States.

used to justify much of the Democratic Party's climate agenda.

The nation that leads in the creation of a clean energy economy will be the nation that leads the 21st-century global economy.

Speaking in Indiana on July 29th, Mr. Zeldin joined by, amongst others, Energy Secretary Chris Wright, said that the EPA is now proposing to undo what Congress never gave the agency authority to do, regulate greenhouse gases.

This ruling happened, and it happened because they couldn't do it through the House and the Senate and the presidency, the normal lawmaking process.

Regulations that hit mobile sources, stationary sources, airplanes. Now, where did this power come from, one might ask?

Well, it arose after a five-four Supreme Court majority ruled in the 2007 case, Massachusetts vs EPA, that greenhouse gases could qualify as pollutants. Ergo, the EPA must regulate them if it finds them to be a danger to the public.

It's a legal question of whether or not the federal government has the legal authority to regulate greenhouse gases as a pollutant. And the prior administration said that they thought they had that legal authority, but they did not take action. that legal authority, but they did not take action. Now the Supreme Court has settled that matter for us, Now the Supreme Court has settled that matter for us and analyze it and see where we go from there.

And that's where the Obama 2009 endangerment finding that provides support for federal climate dictats came from.

And the EPA said that carbon dioxide when mixed with a bunch of well-mixed gases, many of which aren't even admitted from mobile sources, that that contributes to global climate change.

The distinction.

The amount is north of zero. And then they say that climate change endangers public health and welfare.

Yes, the 2009 endangerment finding acknowledged scientific uncertainties about the effect of CO2 emissions on temperatures, extreme weather, allergies, diseases and more. But it cherry picked studies to support the dubious proposition that greenhouse gases pose a clear and present danger to the public.

See, some would like to simplify what the endangerment finding is by just saying, "Carbon dioxide endangers human health and welfare." Now, that is a very oversimplified statement to the point that it's just not accurate when you look at what the endangerment finding did.

Mr. Zeldin said that the EPA had relied on assumptions that ended up not being true and made predictions about the science that in many respects also turned out not to be true.

And I'll tell you, when the Supreme Court ruled in Loper Bright overturning the Chevron Doctrine and making it clear that I, as administrator of EPA, that agencies of this federal government do not have the ability to just creatively come up with our own law, we do not have that power on our own to decide as an agency that we are going to combat global climate change because we give ourselves that power.

The Energy Department has now published a comprehensive analysis of climate and its uncertainties by five outside scientists with differing views. But as Mr. Wright puts it, those who follow the data and follow the facts.

Electric vehicles are not climate tools, but they're politically popular 'cause rich people like 'em. So they've been deemed to be climate solutions. We wanna get back to science and data and facts.

Both the Obama and Biden EPAs used the endangerment finding to justify electric-vehicle mandates and rules forcing the retirement of fossil fuel-fired power plants. Some progressives went further, urging them to regulate CO2 emissions from leaf blowers, lawnmowers and commercial buildings to help eliminate the use of fossil fuels. Democrats will sue to block the Trump repeal when it's final, and that will make the administration's day. Conservatives have long wanted the Supreme Court to revisit Massachusetts vs EPA, which contravenes its major questions, doctrine, rulings. Hats off to both Lee Zeldin and Chris Wright for not shrinking from this fight.

We wanna hear from the American public to finalize a regulation that not only proposes to rescind the endangerment finding, but all greenhouse gas emissions that followed on light, medium and heavy-duty vehicles.
